The agreement

These terms are the agreement between you and sendkan, started by Rachata Suksereekul in Bangkok, Thailand. They apply whenever you use sendkan: as the owner of a space, an organizer, a judge or a participant. A space is anything you set up on sendkan: a simple submission, a competition or a project. By using sendkan, you agree to these terms.

If you use sendkan for an organization, you confirm you’re allowed to accept these terms for it.

Your account

Keep your sign-in details to yourself, and tell us if you think someone else is using your account. You’re responsible for what happens in it.

Give accurate details. You must be old enough to agree to these terms where you live, or have permission from a parent or your school.

Your work stays yours

Participants own what they submit. Organizers own what they publish in their space.

To run the service, you allow sendkan to store your content, copy it where needed (for example, to make previews), and show it to the people who should see it: the space’s organizers and judges, and anyone its page is public to. This permission ends when the content is deleted.

You confirm you have the right to upload what you upload.

If you run a space

  • You’re responsible for your space: its rules, deadlines and judging, and the results, grades and feedback you publish. sendkan adds up scores and grades the way you set them up. The decisions are yours.
  • You decide what participants are asked for. Ask only for what you need, tell them how you’ll use it, and handle it lawfully, including under Thailand’s PDPA.
  • Peer ratings are private to your organizing team. Use them fairly, and don’t share what one participant said about another.
  • Invite organizers you trust: they can run the space with you. Only the owner can change the team or the plan, or delete the space.
  • Deleting a space deletes everything in it, for everyone. It can’t be undone.

Data in your space

For what participants submit in your space, you decide why it’s collected and how it’s used. sendkan processes it for you, only to run the service, as described in our Privacy policy.

If a security incident affects your space, we’ll tell you without delay.

Acceptable use

Don’t use sendkan to:

  • upload anything illegal or malicious, or anything that infringes someone else’s rights
  • harass, deceive or impersonate anyone
  • send spam, or collect other people’s data without their permission
  • break, overload or get around sendkan’s security, including scraping, automated sign-ups and probing for weaknesses

We may remove content or suspend accounts that break these rules. Where we can, we’ll tell you why.

Plans, storage and payment

StarterPro
PriceFree$9 a month
Live spaces at a time1Unlimited
Storage included15 GB100 GB
Largest file50 MB150 MB
Storage beyond what’s includedNot available$0.10 per GB a month

On Starter, the included storage is the limit: once it’s full, new files can’t be added until space is freed or you move to Pro. On Pro, extra storage is measured on the month’s average and uploads are never blocked.

Prices are shown before you pay. Payments aren’t switched on yet, so nothing is charged until they are and you’ve been told in advance. If prices change, we’ll tell you before the change applies to you.

Availability and changes

We work to keep sendkan running and your files safe, but we can’t promise it will always be available or free of errors. Keep your own copies of anything important.

We improve sendkan often, and may change or retire features. If a change takes away something you rely on, we’ll tell you first where we can.

Ending

You can stop using sendkan at any time, and ask us to remove your account.

We may suspend or close an account that breaks these terms, puts others at risk, or where the law requires it. A suspension can be lifted. Closing an account deletes its data as our Privacy policy describes.

Liability

sendkan is provided as it is. As far as the law allows, we aren’t liable for indirect or consequential losses, such as lost profits, missed opportunities or the outcome of a competition or a course.

As far as the law allows, our total liability to you is limited to what you paid us in the twelve months before the claim. Nothing in these terms limits liability that the law doesn’t allow us to limit.

Law and changes to these terms

These terms are governed by the laws of Thailand, and the courts of Thailand will hear any dispute.

We may update these terms. We’ll change the date at the top and tell you in advance about significant changes. If you keep using sendkan after they take effect, you accept them.
